Mandate

As a self-governing profession pursuant to the Legal Profession Act, the legal profession carries out its statutory mandate to protect the public of Nunavut by regulating its lawyer-members through the Law Society. The vehicle by which the Law Society manages the conduct of lawyers is through the Discipline Committee. The Discipline Committee is a standing committee of the Law Society and is the only one that requires that its members have a minimum length of experience as lawyers in order to be appointed to serve. Their experience permits the Committee to receive well-reasoned advice and knowledgeable opinions about matters of considerable importance to the member and the public.


New! In April 2014, the Council of the Federation of Law Societies of  Canada adopted new National Discipline Standards  These standards have been referred to the law societies for adoption and implementation effective January 1, 2015.

A core function of Canada’s law societies is to hear and investigate complaints about member conduct and if necessary, to impose disciplinary sanctions.

The Federation of Law Societies of Canada is working with Canada’s law societies to develop high national standards for how they handle complaints to ensure that members of the public are treated promptly, fairly and openly wherever in Canada they have used the services of members of the legal profession.

National Discipline Standards Pilot Project

The LSN on April 1, 2012 implemented the National Discipline Standards Pilot Project (“NDSP”), created by the Federation of Law Societies of Canada to standardize the legal profession’s regulatory framework related to discipline complaints.

The project establishes appropriate timelines for investigations, citations and hearings; to provide for greater transparency, public participation and accessibility to ­information in the discipline process.

From the date of implementation, the LSN has developed a timeline grid sheet used in each new discipline file to ensure the application of the Standards.

The NDSP mandate is executed by the LSN in accordance with the distinctive nature of the legal profession in Nunavut, and in agreement with the Legal Profession Act (“LPA”) and the Rules of the Law Society of Nunavut (“Rules”).

The LSN adopted policies or reaffirmed statutory obligations in light of the NDSP pertaining to:

  1. Publication of a Notice of Hearing
  2. Use of electronic means for conducting hearings and mandatory in-person participation
  3. Public Access to a Member’s Discipline History
  4. Member Compliance with the Disciplinary Process

Code of Conduct  

The Law Society abides by the Canadian Bar Association’s Code of Conduct and has incorporated those rules into its own Rules. For instance, lawyers adhere to the following professional principle.

The lawyer should assist in maintaining the integrity of the profession and should participate in its activities.

Commentary

Guiding Principles

  1. Unless the lawyer who tends to depart from standards of professional conduct is checked at an early stage, loss or damage to clients or others may ensue. Evidence of minor breaches may, on investigation, disclose a more serious situation or may indicate the beginning of a course of conduct that would lead to serious breaches in the future. It is, therefore, proper for a lawyer to report to [the Law Society of Nunavut] any occurrence involving a breach of this Code unless the information is privileged or it would otherwise be unlawful for the lawyer to do so. Where, however, there is a reasonable likelihood that someone will suffer serious damage as a consequence of an apparent breach, for example, where a shortage of trust funds is involved, the lawyer has an obligation to the profession to report the matter [to the Law Society of Nunavut] unless the information is privileged or it is otherwise unlawful to do so.
  2. The lawyer also has an obligation to the profession to report to [the Law Society of Nunavut] (unless to do so would be unlawful or would involve a breach of privilege):
    • a misappropriation or misapplication of trust money or other property held in trust;
    • the abandonment of a law practice;
    • participation in criminal activity related to a lawyer’s practice;
    • the mental instability of a lawyer of such a serious nature that the lawyer’s clients are likely to be severely prejudiced; and
    • any other situation where a lawyer’s client is likely to be severely prejudiced.

In all cases, the report must be made bona fide and without ulterior motive. Further, subject to local rules, the lawyer must not act on a client’s instructions to recover from another lawyer money or other property allegedly misappropriated by the other lawyer unless the client authorizes disclosure to [the Law Society of Nunavut] and the lawyer makes such disclosure.

The Law Society also invites the public to contact it in regard to any concerns that a client or another person may have regarding the activities of a lawyer. The manner in which a client or member of the public may contact the Law Society is set out below.
